The Case Background
The situation involved an unlawfully terminated permanent contract, followed by complications regarding residence status and eligibility for unemployment benefits through the Dutch UWV (Uitvoeringsinstituut Werknemersverzekeringen).After resolving the work permit issue, the application for unemployment benefits was rejected. UWV argued that the individual was not “available for work” due to the absence of a valid work permit at the relevant time. Once the permit was obtained, the agency shifted its position, claiming it was now “too late” to apply.
UWV’s main arguments were:
The claimant was not available to accept work within the meaning of the Unemployment Insurance Act (Werkloosheidswet – WW).
No new facts or circumstances were presented in subsequent applications.
Rejections followed in March, June, August, and September 2023, citing Articles 17, 17a, 16a of the WW and related provisions of the General Administrative Act.
Overcoming Bureaucratic Deadlock

This result shows how a seemingly lost case, burdened by bureaucratic logic and initial skepticism, could be turned around through persistent, fact-based analysis.
